I am a barrister sole. I am highly experienced in all aspects of construction law and have advised clients at all stages of construction projects, from the front end to completion.
I have acted for clients in multiple adjudications and debt recovery proceedings under the Construction Contracts Act 2002, and I have advised clients on compliance with all aspects of the Act. I assist clients to resolve construction disputes through direct discussions, negotiation and mediation. I have acted for clients in arbitrations and High Court cases in claims about defects in buildings, and disputes regarding payments, weathertightness, variations, delays, earthquake strengthening and asbestos.
As well as dispute resolution, I provide advice to parties at the outset of construction projects, including the selection of the appropriate procurement model, project structure and tendering procedures. I draft construction contracts, guarantees, consultant conditions of contract, development agreements, funding agreements and bonds. I am highly experienced with all New Zealand’s standard-form construction contracts and subcontracts, including NZS 3910:2013, NZS 3916:2013, and NZIA, RMBF and CCNZ contracts.
My clients have included contractors, subcontractors, developers, owners, government departments, councils, tenants, consultants and project managers. I am a regular public speaker in infrastructure and construction law. I have wide industry knowledge of the construction sector in New Zealand.
I graduated with a first class honours degree in law from Victoria University in 1999, and started working for Kensington Swan in 2000 in the construction law team. In December 2007, I became a partner at Kensington Swan. In 2009, I became the co-leader of Kensington Swan’s highly successful major projects and construction law team which works around New Zealand. I was also on the board of Kensington Swan.
