Step Six: Right of Rejoinder by the Respondent

An adjudicator who receives a claimant’s written reply to a respondent’s response may allow the respondent up to two working days to serve a rejoinder to the claimant’s reply.

If you are a respondent, you may apply to the adjudicator to serve a rejoinder to the claimant’s reply. You should do so immediately upon receipt of the reply as any application must be dealt with and the rejoinder served within two working days of receipt of the reply. There is no power to extend the time beyond the two working days provided under s37A(4)(b).
